Hezekiah Hopkins´ Last Will and Testament

I Hezekiah H. Hopkins of sound mind and disposing memory in view of the certainty of death and the uncertainty of the time whereof do make and contribute this my last will and testament hereby revoking all former wills by me made.

Item 1st    It is my will that out of my Estate all my just Debts and Funeral expenses be paid.

Item 2nd     After the payment of my said debts and funeral expenses I do give and bequeath all of my Estate both Real and Personal to my beloved wife Elizabeth D. Hopkins Said bequest to include land and tenements with all their appurtenances, Leases held, property equities of redemption, and all rights and interests of every Kind and description, whether legal or equitable that I may own or hold at my death in as to any real estate whatever, all my personal property of any kind and description including Bills, Bonds, Notes, Book accounts and all causes in action of any Kind and description and whatever also of personal and mixed Estate I may die possessed of or entitled to.

This bequest to my beloved wife to be without charge or condition of any kind whatever for her own benefit and subject to her own control to her and her heirs forever.

It is further my will that all of my said property vest in my said wife at my death without the interposition of the Executor or administrator with will annexed and without the interference of any Probate Court whatever, and that upon my said Legate paying said debts her right and title to all and singular of every part of my said estate vest in her absolutely and as fully as the same may be vested in me at my Death. In testimony whereof I have hereunto set my hand and seal this 14th day of April A.D. 1858.

Be it remembered That on the 30th day of December 1869, David H. Bowman, one of the subscribing witnesses to the within and foregoing last will and testament of Hezekiah H. Hopkins late of said County deceased, personally appeared before me D. C. Baker Clerk of the Court of Common Pleas of Jay County, in the State of Indiana, and being duly sworn by the Clerk of said Court, upon his oath declared and testified as follows, that is to say, that on the 14th day of April 1868 he saw the said Hezekiah H. Hopkins sign his name to said instrument in writing, as and for his last will and testament, and that this deponent at the same time heard the said Hezekiah H. Hopkins declare the said instrument in writing to be his last will and testament, and that the said instrument in writing was at the same time, at the request of the said Hezekiah H. Hopkins, and with his consent attested and subscribed by the said David H. Bowman, in the presence of said Testator, and in the presence of each other as subscribing witnesses thereto, and that the said Hezekiah H. Hopkins was at the time of the signing and subscribing of the said instrument in writing as aforesaid of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes, and further the deponent says not.

Note: Hezekiah Haddon Hopkins was the youngest son of Hezekiah Hopkins and Martha Griffith. He was born Dec 14, 1816 in Pennsylvania, and married Elizabeth Dawson, daughter of John and Jane Dawson, on Oct 3, 1844 in Wells County, Indiana. They had two children: Harriet Amelia, b. Jun 27, 1845, and Albert Haddon, b. May 2, 1850. Elizabeth Dawson Hopkins died Jan 30, 1884. Like his older brothers, Richard and William, Hezekiah was an early settler of Camden, Indiana, later renamed Pennville.
